A federal appeals court has affirmed a New York appeals court’s December ruling that a lower New York Court ruled erroneously in granting a right of protection for pre-1972 sound recordings in a case brought by Turtles founders Mark Volman and Howard Kaylan. The federal court has remanded the case to the state district court and ordered that defendant Sirius XM be granted its motion for summary judgment dismissing the case.
