CALLS PERFORMANCE TAX "RIDICULOUS."
At the NAB State Leadership Dinner in Washington
this week, House Energy and Commerce Committee
Chairman Emeritus John Dingell (D-MI) told an
approving audience, "I’d like to express my
opposition to legislation imposing a performance tax
on broadcasters. I am concerned that such a tax
would be of less benefit to recording artists than
to record labels, many of which are based abroad."

THIS WEEK IN PERFORMANCE ROYALTIES, PART TWO:
LOCAL RADIO FREEDOM ACT SUPPORT GROWS.
The non-binding resolution that opposes the
imposition of performance taxes on radio stations
has picked up four new House members, bringing the
total to a healthy majority of 256 cosponsors.
THIS WEEK IN PERFORMANCE
ROYALTIES, PART THREE: POINT, COUNTERPOINT.
The recording-industry-backed MusicFirst coalition
took the opportunity of broadcasters flooding
Washington, DC this week to hold a press conference
announcing its new pro-Performance Rights Act
publicity campaign. Meanwhile, NAB Executive Vice
President, Media Relations Dennis Wharton responded
to the MusicFirst statements.
SURVEY SEZ: AD SPENDING DOWN 9%
LAST YEAR. According to
the Nielsen Company, total U.S. ad spending fell 9%
last year, but only 2% in the fourth quarter,
showing a decline in the decline.
SIRIUS XM CROSSES THE (BOTTOM)
LINE. In the fourth
quarter of 2009, Sirius XM Radio reported a net
income of $14.2 million, compared to a net loss of
245.8 million for the year before.
GENE
CHENAULT, 90. The longtime
radio impresario, who teamed with legendary
programmer Bill Drake to bring the Drake format to
the masses, has died in Los Angeles.
ETHNIC GROUP COMPLAINS ABOUT
ETHNIC MEDIA SHUTOUT.
Sandy Close, executive director of America Media, a
minority advocacy group, testified before Congress
last week that the U.S. Census Bureau is shunning
ethnic media in its 2010 census campaign.
