Federal Court: Not so fast, Prometheus.

The Third Circuit Court of Appeals has denied Prometheus Radio Project’s petition for a writ of mandamus to prevent the FCC from changing broadcast ownership rules to permit cross-ownership of broadcast and newspaper properties, and radio and TV properties, in the same market. In its ruling, the Court held that Prometheus had not met the standard for mandamus—had not shown that the government had overstepped its bounds or erred legally. The NAB praised the decision; Executive Vice President/Communications Dennis Wharton commented, “We are grateful that the Court rejected the mandamus request and that meaningful reform of outdated broadcast ownership rules can go forward.”
